Version 1.1 — Effective 5 November 2025 Contact: info@mrpsyc.in | +91 82955 45210 This Tele-Psychiatry Compliance & Liability Policy (“Policy”) forms a binding and enforceable legal agreement between Mr. Psyc (operated by its parent entity) (“Company”, “We”, “Us”, “Our”) and any individual (“User”, “You”, “Client”, “Patient”) who accesses, books, or participates in psychiatric consultations, medical assessments, or mental-health evaluations delivered through digital or telecommunication channels provided by the Company. By engaging in a tele-psychiatric session or utilizing any component of the psychiatric service infrastructure, You irrevocably consent to be bound by the terms of this Policy, the Terms & Conditions, Privacy Policy, Medical Disclaimer, Cancellation Policy, and Return & Refund Policy. Tele-psychiatry is governed by legal, ethical, medical, and operational constraints unique to remote psychiatric care. As such, this Policy outlines the required responsibilities, boundaries, permitted conduct, safety obligations, clinical limitations, and liability framework applicable to both parties. Tele-psychiatry cannot replicate all aspects of in-person psychiatric evaluation, particularly when conditions require physical examination, crisis stabilization, laboratory investigations, or emergency intervention. The User acknowledges these limitations and accepts the legal consequences associated with reliance on telemedicine.1. PURPOSE AND SCOPE
This Policy governs all psychiatric consultations conducted:- via video conferencing,
- via audio calls,
- via chat-based consultations (where permitted),
- via integrated digital platforms,
- via hybrid modes involving digital + in-person transitions.
- Telemedicine Practice Guidelines, 2020,
- Medical Council of India Act (as applicable),
- Indian Medical Council (Professional Conduct, Etiquette, and Ethics) Regulations,
- Digital Personal Data Protection Act (DPDP),
- Information Technology Act & Rules.
2. NATURE OF TELE-PSYCHIATRY SERVICES
Tele-psychiatry through the Company:- is a structured medical service conducted by qualified psychiatrists;
- is limited by the inability to conduct physical examinations;
- depends on User-provided information;
- may require follow-up in-person clinical visits;
- is subject to prescription restrictions under telemedicine law;
- may be discontinued if the User’s condition is unsuitable for digital care.
- emergency psychiatric care,
- hospitalization,
- crisis intervention,
- emergency rescue support,
- inpatient stabilization,
- medical examinations requiring physical testing.
3. APPOINTMENT ELIGIBILITY AND USER OBLIGATIONS
To engage in tele-psychiatric consultation, You must:- Be mentally capable of informed consent,
- Provide accurate identification information,
- Disclose complete medical and psychiatric history,
- Provide details of prior diagnoses, medication use, and past hospitalizations,
- Maintain privacy during sessions,
- Ensure stable internet and device functionality,
- Ensure no third party listens to or interferes with the session (unless permitted),
- Follow psychiatrist recommendations, particularly those requiring in-person follow-up.
4. CONDITIONS UNSUITABLE FOR TELE-PSYCHIATRY
The User acknowledges that tele-psychiatry is not appropriate for evaluating or treating the following conditions, including but not limited to:- acute suicidal intent or self-harm impulses,
- homicidal ideation or violent behaviour,
- delirium or confusion,
- severe psychosis or hallucinations with impaired insight,
- substance intoxication or withdrawal,
- medical emergencies,
- mania with agitation,
- seizure disorders requiring urgent evaluation,
- uncontrollable panic attacks with physical symptoms,
- accidental overdoses,
- psychiatric conditions requiring immediate hospitalization.
5. TELEMEDICINE PRESCRIPTION LIMITATIONS
Under Indian telemedicine regulations:- Certain psychiatric medications cannot be prescribed without an in-person consultation.
- Schedule X medications and habit-forming psychiatric drugs are prohibited for digital prescription.
- Dosage adjustments for complex psychiatric medications may require physical evaluation.
- Psychiatrists must rely exclusively on their professional discretion to determine prescription eligibility.
- A psychiatrist’s refusal to prescribe medication is not grounds for complaint or refund.
- The psychiatrist may request in-person evaluation prior to prescribing or altering medication.
- The psychiatrist must comply with legal restrictions even if the User insists otherwise.
6. CONSENT AND VOLUNTARY PARTICIPATION
By participating in tele-psychiatry, You provide explicit consent to:- engage in medical consultation digitally,
- allow the psychiatrist to evaluate You based on available information,
- adhere to legal boundaries governing digital medical practice,
- accept limitations of remote psychiatric care,
- permit the creation of clinical notes and records,
- follow diagnostic and treatment recommendations,
- seek emergency care when advised.
7. PRIVACY, RECORDS, AND DATA PROTECTION
Tele-psychiatry involves sensitive personal and medical information. Data is handled in accordance with the Privacy Policy.7.1 No Recording
You are strictly prohibited from recording audio, video, or capturing screenshots of the session without formal written consent of the psychiatrist and the Company.7.2 Clinical Notes
Psychiatrists may maintain clinical notes. These are confidential professional documents and are not required to be shared with Users.7.3 Data Confidentiality
Confidentiality may be lawfully breached only if:- there is immediate risk to Your life,
- there is risk of harm to others,
- mandated by court order or law enforcement,
- required for medico-legal compliance.
8. USER RESPONSIBILITIES DURING CONSULTATION
You agree to:- Attend the session from a private and quiet location,
- Ensure functional audio and video devices,
- Avoid intoxicants during sessions,
- Not involve third parties without prior disclosure,
- Participate actively and truthfully,
- Follow treatment plans and medication guidelines,
- Report adverse medication reactions promptly,
- Seek offline medical help if advised.
9. LIMITATIONS OF DIAGNOSIS AND TREATMENT
The User acknowledges:- Digital consultation may restrict visual cues necessary for diagnosis.
- Psychiatric conditions may mimic medical illnesses requiring tests that cannot be performed online.
- Tele-psychiatry depends entirely on User honesty and disclosure.
- Complex mental-health disorders may require multiple offline evaluations.
10. LIABILITY LIMITATIONS
The Company, its psychiatrists, staff, affiliates, and partners shall not be liable for any damages resulting from:- reliance on tele-psychiatry advice where in-person care was required,
- failure to disclose relevant medical history,
- refusal to follow psychiatric instructions,
- misuse or alteration of prescribed medication,
- adverse reactions due to non-compliance,
- failure to seek emergency care when advised,
- inaccurate self-reporting,
- interruptions in digital communication,
- environmental disruptions affecting assessment quality,
- misinterpretation of psychiatrist recommendations.
11. MISUSE OF TELE-PSYCHIATRY SERVICES
Misuse includes but is not limited to:- demanding prohibited medications,
- using services to obtain legal documentation,
- harassing or manipulating psychiatrists,
- providing false identity or medical information,
- recording sessions without consent,
- threatening self-harm as leverage for prescriptions,
- misusing consultations for relationship or legal disputes.
- permanent account suspension,
- refusal of future services,
- report to authorities,
- legal action for misconduct.
12. TERMINATION OF CONSULTATION BY PSYCHIATRIST
A psychiatrist may terminate the session immediately if:- the User is abusive,
- the User is intoxicated,
- privacy cannot be maintained,
- the User refuses to comply with instructions,
- the User requires emergency care,
- the User demands unethical or illegal prescriptions,
- technical issues render assessment impossible.
13. FOLLOW-UP, CONTINUITY, AND MEDICATION MANAGEMENT
You acknowledge that:- Medication changes require consistent follow-up,
- Non-compliance may result in reduced effectiveness,
- Long-term treatment requires structured continuity,
- Failure to schedule follow-up may compromise treatment outcomes,
- The psychiatrist may refuse prescription renewal without timely review.
14. EMERGENCY & CRISIS LIMITATION CLAUSE
The platform does not provide:- suicide prevention support,
- crisis stabilization,
- emergency psychiatry,
- ambulance dispatch,
- emergency medication management.
- suicidal thoughts,
- violent urges,
- severe panic or agitation,
- hallucinations or delusions,
- medication overdose,
- withdrawal crisis,
15. GOVERNING LAW, DISPUTE RESOLUTION, AND JURISDICTION
This Policy is governed by the laws of India. Any disputes arising from tele-psychiatry services shall fall under the exclusive jurisdiction of the courts located in the jurisdiction where the parent entity of Mr. Psyc is registered. You agree not to initiate disputes without first contacting the Company for resolution.16. FINAL ACKNOWLEDGMENT
By booking or participating in tele-psychiatry through the Company, You affirm that:- You understand the limitations and risks of telemedicine,
- You acknowledge the need for in-person care when advised,
- You agree to provide complete and truthful information,
- You accept full liability for non-compliance or concealment,
- You waive liability for limitations inherent to remote psychiatric care,
- You consent to all boundaries, restrictions, and regulations in this Policy.
