MR. PSYC — TERMS & CONDITIONS
Version 1.1 — Effective 5 November 2025 Contact: info@mrpsyc.in | +91 82955 45210 These Terms and Conditions (“Agreement”, “Terms”, “T&C”) constitute a binding legal contract between Mr. Psyc (operated by its parent entity) (“Company”, “We”, “Us”, “Our”) and any individual, client, User, visitor, organization, institution, counsellor, psychiatrist, trainee, or entity (“You”, “Your”, “User”, “Client”, “Participant”) who accesses or uses any Services offered by the Company, including mental-health counselling, psychotherapy, psychiatric consultations, behavioural programs, digital screening tools, nurturing systems, LMS training, corporate and school wellbeing initiatives, or any content, platform features, or materials associated therewith. By accessing or using any part of the platform—including website, mobile app, digital interfaces, assessment tools, booking systems, communication portals, or content libraries—you fully agree to be bound by these Terms, the Privacy Policy, Cancellation Policy, Return & Refund Policy, Medical Disclaimer, and any additional policies posted or updated by the Company from time to time. If You do not agree to these Terms, You must immediately discontinue use of all Services and refrain from accessing any content or functionality provided by the Company. These Terms constitute an enforceable contract and supersede any prior verbal, written, informal, or implied understandings. No counsellor, psychiatrist, employee, affiliate, agent, representative, or third party has the authority to amend, waive, or contradict these Terms unless such modification is expressly issued by the Company in writing.
1. NATURE AND SCOPE OF SERVICES
The Company provides mental-health related services which may include counselling, psychotherapy, behaviour modification guidance, psychiatric consultations, mental-health screenings, digital habit-building modules, emotional wellbeing programs, AI-assisted nurturing, blogs, articles, educational materials, and online learning modules. The User acknowledges that:
  1. Counsellors and psychologists provide emotional support, behavioural strategies, and psycho-educational guidance, not medical treatment.
  2. Psychiatrists provide medical advice only within the legal scope of telemedicine and may refuse online diagnosis or prescriptions when clinically inappropriate.
  3. Digital programs, content, and AI messages are wellbeing tools, not clinical treatment.
  4. The platform does not provide emergency or crisis services.
  5. Screenings and assessments are preliminary indicators and do not constitute diagnosis.
The User expressly agrees that the Company is not responsible for medical emergencies, critical psychiatric episodes, self-harm prevention, or crisis management.
2. ELIGIBILITY AND ACCOUNT RESPONSIBILITIES
To use the Services, You must meet the following eligibility criteria:
  1. You must be at least eighteen (18) years old.
  2. If You are a minor, a parent or legal guardian must create, manage, and supervise the account.
  3. You must have the legal capacity to enter into binding agreements under applicable law.
  4. You must provide truthful, accurate, complete, and updated information.
You are responsible for maintaining the confidentiality of Your login credentials, ensuring that no unauthorized person gains access to Your account. All actions conducted under Your account shall be deemed as performed by You. You shall immediately notify the Company of any unauthorized access, suspicious activity, or misuse of Your account.
3. PROHIBITED USES AND USER CONDUCT
You agree not to:
  1. Misrepresent Your identity, age, or medical condition.
  2. Harass, abuse, threaten, manipulate, or behave inappropriately toward counsellors, psychiatrists, staff, or other Users.
  3. Attempt to force counsellors or psychologists to provide medical advice.
  4. Request prescriptions, medication adjustments, medical certificates, legality-related evaluations, or clinical documents from non-medical professionals.
  5. Record, screenshot, or distribute any part of a session without explicit mutual written consent.
  6. Upload, share, or transmit harmful, illegal, obscene, defamatory, or inappropriate content.
  7. Exploit, hack, damage, disrupt, or reverse-engineer any part of the platform.
  8. Impersonate another person, organization, or healthcare provider.
  9. Use the platform in a manner that violates medical laws, telemedicine guidelines, or licensing norms.
  10. Conduct data scraping, unauthorized data extraction, or attempt to access restricted sections.
  11. Market, promote, or advertise external services without written permission from the Company.
Violation of any of the above may result in immediate account suspension, legal action, reporting to authorities, or permanent ban.
4. COUNSELLING AND PSYCHIATRIC SERVICE LIMITATIONS
4.1 Counselling
Counselling offered through the platform is supportive and psycho-educational. Counselors:
  • do not prescribe medicines,
  • do not diagnose medical disorders,
  • do not issue medico-legal documents,
  • do not provide emergency intervention,
  • may refer You to a psychiatrist or physician if necessary.
4.2 Psychiatry
Psychiatrists may provide medical advice, diagnosis, or prescriptions only within telemedicine legal boundaries. They may refuse service if:
  • the condition requires physical examination,
  • the User withholds necessary information,
  • the mental-health state indicates crisis or danger,
  • the User insists on medications not permitted via telemedicine,
  • environmental privacy is inadequate.
4.3 No Guarantee of Continuity
The Company does not guarantee the continued availability of any specific professional. Professionals may change, discontinue, or adjust their availability due to emergencies, licensing changes, or operational constraints.
5. FEES, PAYMENTS, BILLING, AND FINANCIAL TERMS
Payments for all Services must be made in advance unless explicitly stated otherwise in writing. By purchasing or subscribing, You authorize the Company to:
  • charge Your payment method,
  • store payment details (securely through a compliant gateway),
  • renew subscriptions automatically where applicable,
  • deduct cancellation fees,
  • process penalty charges for no-shows.
The User acknowledges:
  1. Fees once paid are subject to the Cancellation and Refund Policies.
  2. Auto-renewals are non-refundable unless cancelled within permitted windows.
  3. Discounted packages cannot be partially refunded.
  4. Price changes may occur without prior notice for new purchases.
  5. Promotional credits, offers, and coupons cannot be redeemed for cash.
  6. Chargebacks raised without first contacting the Company constitute a violation.
The Company reserves the right to suspend or terminate services for payment disputes, fraudulent transactions, or unauthorized financial activity.
6. SCHEDULING, CANCELLATION, NO-SHOWS, AND RESCHEDULING
Scheduling is based on professional availability.
6.1 Counselling Sessions
A counselling session may be cancelled or rescheduled subject to strict timelines dictated in the Cancellation Policy. Late cancellations or no-shows are charged fully.
6.2 Psychiatric Sessions
Psychiatric consultations follow stricter timelines due to clinical preparation. Late cancellations incur higher penalties.
6.3 Company-Initiated Rescheduling
If the Company or a professional cancels due to unavoidable reasons, the User may opt for a rescheduled slot or receive a refund for the particular session.
6.4 User Delay
If the User joins late, the session will still end at the scheduled time, and no compensation is provided. Repeated cancellations or no-shows may result in account restrictions.
7. DIGITAL PROGRAMS, SELF-HELP MODULES, SCREENINGS, AND AI-GENERATED CONTENT
Digital content is offered for educational and wellbeing purposes. It is not therapeutic or medical advice. The User acknowledges:
  1. Behavioural modules are not a substitute for therapy or psychiatric treatment.
  2. Screenings are preliminary and not diagnostic.
  3. AI-generated content is supportive, not clinical.
  4. Content may be updated, removed, or modified without notice.
  5. Digital programs are non-refundable if accessed, even partially.
No claim may arise from perceived inaccuracy, dissatisfaction, or interpretation of digital content.
8. INTELLECTUAL PROPERTY RIGHTS
All intellectual property (“IP”) including:
  • text,
  • graphics,
  • videos,
  • audio content,
  • screening questionnaires,
  • program modules,
  • AI models,
  • LMS lessons,
  • trademarks,
  • software,
  • platform design,
  • therapeutic frameworks,
  • behavioural models developed by the Company,
belongs exclusively to the Company. You agree:
  1. Not to copy, reproduce, distribute, or republish any IP.
  2. Not to reverse-engineer or extract proprietary methodologies.
  3. Not to use content for commercial, academic, or clinical purposes without written authorization.
  4. Not to create derivative works or replicate content for external platforms.
Unauthorized use of IP may lead to legal action.
9. TERMINATION OF ACCOUNT
The Company reserves the right to terminate, suspend, or limit access to the User’s account under the following conditions:
  • violation of any T&C clause,
  • misuse of services,
  • harassment of professionals,
  • attempt to obtain illegal services (e.g., medical certificates),
  • repeated cancellations or no-shows,
  • chargeback attempts,
  • fraudulent identity or payment behaviour,
  • threats or abusive conduct,
  • violation of telemedicine rules.
Upon termination:
  1. All pending sessions may be forfeited.
  2. No refund shall apply unless expressly approved under refund policy.
  3. Access to digital programs may be revoked.
  4. Data retention and deletion shall follow the Privacy Policy.
Termination decisions shall be at the sole discretion of the Company.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, the Company, its owners, directors, officers, employees, counsellors, psychiatrists, contractors, affiliates, agents, licensors, or service partners shall not be liable for any direct, indirect, incidental, consequential, punitive, exemplary, or special damages arising from or connected to:
  • Your use or inability to use the Services,
  • Your reliance on counselling, digital content, or AI-generated assistance,
  • Misinterpretation of therapeutic guidance,
  • Clinical limitations of tele-counselling or tele-psychiatry,
  • Emotional discomfort or psychological distress,
  • Delayed medical or psychiatric intervention,
  • Decision-making based on digital programs or screening assessments,
  • Device failure, connectivity disruptions, or technical glitches,
  • Errors caused by incomplete or inaccurate information provided by You,
  • Failure to seek emergency help when advised or reasonably required,
  • Adverse effects from medication prescribed by external providers,
  • Disputes arising from professional recommendations.
  • Third-party service interruptions (hosting, payment gateways),
  • Unauthorized access resulting from Your negligence in safeguarding credentials.
The User acknowledges that mental-health service outcomes vary widely and that the Company expressly disclaims all warranties, guarantees, or assurances regarding therapeutic results. No claim shall be admissible for dissatisfaction with counselling style, therapeutic method, communication quality, digital experience, tone of content, or subjective emotional reactions. Your exclusive remedy for any dispute with the Company shall be limited solely to discontinuation of the Service.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless the Company, its owners, operators, counsellors, psychiatrists, affiliates, and employees from any claim, damage, liability, cost, or expense (including attorney fees) arising from:
  1. Your violation of these Terms,
  2. Your misuse of the Services,
  3. Your breach of professional boundaries with counsellors or psychiatrists,
  4. Your unauthorized sharing, recording, or reproduction of protected content,
  5. Your negligence in following medical or therapeutic advice,
  6. Your failure to disclose critical medical or psychiatric history,
  7. Your communication of false, misleading, or manipulated information,
  8. Your illegal or harmful actions toward others,
  9. Your misuse of psychiatric or counselling services for personal, legal, or manipulative purposes,
  10. Any legal claims initiated due to Your conduct during sessions or platform usage.
This indemnity obligation shall survive account termination and extend to all interactions and transactions with the Company.
12. CONFIDENTIALITY AND DATA PROTECTION
Your data is processed in accordance with the Company’s Privacy Policy, which is incorporated into these Terms by reference and carries full legal effect. By using the platform, You acknowledge that:
  1. Mental-health data is highly sensitive and processed under strict confidentiality protocols.
  2. Confidentiality may be breached only under ethical or legal obligations involving risk of harm, court orders, or statutory mandates.
  3. Tele-counselling involves inherent risks associated with digital communication.
  4. The Company may use anonymized or aggregated data for research, analytics, LMS training enhancements, and service improvement.
Your continued usage constitutes explicit consent to all processing activities outlined in the Privacy Policy.
13. THIRD-PARTY SERVICES AND EXTERNAL LINKS
The platform may contain links to third-party websites, apps, webinars, LMS modules, payment gateways, or external resources. You acknowledge that:
  • These external platforms are not controlled or operated by the Company.
  • The Company does not endorse or verify the accuracy of external content.
  • The Company is not liable for any harm or loss arising from Your interaction with third-party services.
  • Any data You share with third parties is governed by their own privacy policies.
Your participation in third-party programs, tools, or integrations is entirely at Your own risk.
14. USE OF ARTIFICIAL INTELLIGENCE (AI) AND AUTOMATION
The Company may use AI for:
  • generating wellbeing messages,
  • habit-building suggestions,
  • reflective prompts,
  • general psycho-educational guidance,
  • appointment reminders,
  • program continuity support.
You acknowledge that AI:
  • does not interpret Your emotions clinically,
  • does not diagnose mental-health disorders,
  • does not replace licensed professionals,
  • cannot be held responsible for Your decisions,
  • may occasionally produce generalized or context-limited responses.
The Company disclaims liability for any misunderstanding, reliance, or emotional interpretation of AI-generated content.
15. SESSION RECORDINGS, DATA SHARING & COMMUNICATION RULES
The User agrees that:
  1. Sessions (counselling or psychiatric) are not recorded by default.
  2. Recording, copying, or streaming any portion of a session without explicit mutual written consent is strictly prohibited.
  3. Counsellors may take confidential therapeutic notes, which You cannot demand or alter.
  4. Sharing screenshots, audio clips, or written correspondence from sessions is a violation of confidentiality.
  5. Communication with professionals outside scheduled sessions is limited to boundaries defined by the Company.
  6. Sending inappropriate messages, threats, or undue pressure to counsellors or psychiatrists is strictly prohibited.
Violation of any communication boundary may result in account termination.
16. PLATFORM AVAILABILITY, TECHNICAL FAILURES, & SERVICE INTERRUPTIONS
The Company strives for continuous availability but does not guarantee that the platform will be:
  • error-free,
  • uninterrupted,
  • free of delays,
  • secure from cyber threats,
  • compatible with all devices,
  • immune to server issues,
  • free from maintenance downtime.
In case of platform malfunction, session disruption, or unexpected downtime:
  • The Company may reschedule affected sessions,
  • Provide reasonable technical support,
  • Offer credits where deemed appropriate,
  • But shall not be liable for financial compensation, emotional distress, or consequential loss.
You agree that Your ability to access Services may depend on Your device, internet quality, environment, and third-party networks.
17. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Any disputes arising from or relating to:
  • Your use of the platform,
  • Your interactions with counsellors or psychiatrists,
  • Your purchase or consumption of Services,
  • Any claim relating to privacy, refund, cancellation, or content usage,
shall fall under the exclusive jurisdiction of the courts located in the jurisdiction where the parent entity of “Mr. Psyc” is registered. You consent to such jurisdiction and waive any objection regarding inconvenient forum.
18. AMENDMENTS, UPDATES, AND MODIFICATIONS
The Company reserves the unilateral right to:
  • modify, update, revise, suspend, or replace these Terms,
  • introduce new features or restrictions,
  • adjust fees,
  • change operational policies,
  • update professional requirements,
  • modify digital programs,
  • revise content and guidelines.
All changes shall take effect upon publication. Continued use of the Service constitutes acceptance of modified Terms. The Company is not obligated to notify Users individually regarding updates.
19. NON-TRANSFERABILITY AND ASSIGNMENT
Your rights under these Terms are personal and cannot be transferred, sold, assigned, licensed, or delegated to any third party without written approval from the Company. The Company may assign its rights and obligations in connection with mergers, acquisitions, restructuring, or organizational transitions, provided that privacy protections are preserved.
20. RELATIONSHIP BETWEEN USER AND COMPANY
The relationship established between You and the Company is strictly that of a service provider and User. There is no:
  • employer–employee relationship,
  • medical institution–patient obligation (except where psychiatrist–patient interactions occur independently),
  • partnership or joint venture,
  • fiduciary relationship beyond data processing duties.
Counsellors and psychiatrists are independent professionals who contract with the Company; they are not employees unless explicitly identified as such.
21. SURVIVAL OF CERTAIN PROVISIONS
Following termination of Your account or cessation of Services, the following provisions shall continue to remain in effect:
  • Liability limitations,
  • Indemnity obligations,
  • Intellectual property rights,
  • Confidentiality terms,
  • Refund and cancellation restrictions,
  • Governing law and jurisdiction,
  • User conduct clauses,
  • Data retention rules (per Privacy Policy).
These provisions survive indefinitely to the extent permitted by law.
22. COMMUNICATION CONSENT
By using the platform, You consent to receive:
  • emails,
  • SMS notifications,
  • WhatsApp messages,
  • reminders,
  • nurturing content,
  • transactional messages,
  • platform alerts,
  • administrative updates,
  • promotional offers (unless opted out).
The Company shall not be responsible for message delays or non-delivery caused by third-party providers. You may update communication preferences but cannot opt out of essential transactional messages.
23. DISPUTE RESOLUTION PROCESS
Before initiating legal proceedings, the User agrees to:
  1. Contact the Company at info@mrpsyc.in outlining the dispute;
  2. Allow reasonable time for investigation;
  3. Engage in good-faith discussions to resolve the matter.
Only unresolved disputes may proceed to legal jurisdiction.
24. FORCE MAJEURE
The Company is not responsible for failure to perform obligations due to circumstances beyond reasonable control, including:
  • natural disasters,
  • pandemics,
  • war,
  • government restrictions,
  • cyber attacks,
  • server failures outside Company ownership,
  • widespread internet interruptions,
  • labour strikes,
  • power outages.
During such periods, services may be delayed, suspended, or modified without liability.
25. ENTIRE AGREEMENT
These Terms, together with:
  • Privacy Policy,
  • Cancellation Policy,
  • Return & Refund Policy,
  • Medical Disclaimer,
  • Any posted guidelines,
constitute the entire agreement between You and the Company, and supersede all prior agreements, discussions, or representations, whether written or oral.
